Athena’s Guide to the 341 Meeting of Creditors

Even though I’m the office manager and not a CAT-torney, I did go to claw school and I received my Doctorate of Fluff degree. On occasion, I do appear in these meetings of creditors, though. Typically, I just walk in front of the camera and sometimes Jeff grabs me and introduces me to everyone. If that gives you an idea about how chill these meetings are, good. That being said, you are under oath so answer the questions honestly. Before the hearing, you should have provided Jeff with the completed questionnaire, copies of your social security card and driver’s license and a bunch of other documents that the trustee requires like paystubs, bank statements and tax returns.

Here are some of the questions that the trustee is likely to ask:

  1. The trustee will have you take the oath and then ask you if you just took the oath. They start with an easy question, for sure.
  2. Is your address correct?
  3. Did you reside in Arizona for the 90 days prior to filing this case?
  4. Have you lived in Arizona for 2 years?
  5. Have you filed bankruptcy in the past 8 years?
  6. Have you filed bankruptcy using a different social security number?
  7. Did you read and sign the petition and schedules filed for you in this case?
  8. Is the information in the petition and schedules true and correct?
  9. Did you list all of your assets?
  10. Did you list all of your debts?
  11. Have there been any changes since filing?
  12. Are you the beneficiary of a will or trust?
  13. Have you waived your right to inherit any money in the last 6 years?
  14. Have you inherited any money in the last 3 years?
  15. Is your social security number correct as it appears on the 341 notice from the court?
  16. Do you have any domestic support obligations like child support or alimony?
  17. Are you current on those obligations?
  18. Have you filed your last 2 years of federal and state income tax returns?
  19. Are you married?
  20. Are you employed? If so, what is the address of your employer?

Then the trustee will ask any specific questions about your case and the documents you provided prior to the hearing. They may ask about large transactions on bank statements, loan repayments, transfers of assets, or other stuff. It’s not super common in a Chapter 13 but more common in a Chapter 7 hearing.


Finally, the trustee will see if there are any creditors present with questions. This is SUPER rare. I’ve had under 10 creditors appear in 15 years and they typically have pretty inane questions. I’ve seen some other people get destroyed, though, but not my clients.

What to wear:

While I don’t ever wear clothes because I’m a cat, I would recommend that you wear some clothes to the hearing. If you think it might be cool to wear a fur coat like me, think again. While I wear a fur, that may not be the best look for a meeting of creditors. Remember, we are in poor people court, not walking the runway in Milan. Dress like you’re going to Walmart.
